    Default Recourse Against Developer for Failure to Follow Through with Agreement

    There is a new neighborhood development going in across the street from me. I live near the Hobby Lobby Headquarters. The development plans were denied by the planning commission/zoning commission (I forgot what the actual name of it was). The reason for the denial was the planned homes were not in conformance with the other neighborhoods in the area. The developer appealed to the OKC City Council and won. I watched the meeting after the fact because it was on a Tuesday and I had to work. The developer plead his case. Then two neighbors adjacent to the development plead their case against it. After the neighbors pleas, the developer agreed to brick the homes completely around. more fencing and such. Previous plans were to brick three sides. Before the vote, Larry McAtee gave a speech about how wonderful the neighborhood was going to be, the yards are tiny because younger owners don't want take care them, and yada, yada, yada . I said to myself, the fix in for Larry. The council then voted unanimous.

    The homes are being built and sure enough they are bricked on three sides even though the developer agreed to brick all sides during the council meeting.

    Here is my question(s).

    Was this agreement during the council meeting binding? Anyone know what office in the city I should/can complain to? I know I can contact Larry McAtee, but I never get any good information from his office. Last time his assistant told me she should call back, never did.

    Call the Planning Department.

    They should be able to help you.
