    Just spit ballin' here:

    Suitability as organ donor testing gets scheduled for accused person and reported to prosecution before the capital or no capital case decision is ever made.

    Shady attorney or prosecutor promises accused a wealthy donor will provide for the accused's family if he quietly takes a plea that includes death and waives appeals.

    Wealthy person pays a PI to set up someone who is a match for Daddy Big bucks daughter and then point cops that way.

    Any of the above, but not involving wealth, just the right heartstring tugs by someone.

    In short, if there is a way to scam something, then a scam will arise.

    I don't like the idea because it could turn into a organs for cash enterprise for transplant doctors. "Let's us have your organs and we will pay your family a nice little reward or we will pay for a lawyer to assist you through the appeals process if you give us an organ."
